In the case of Fjord Village v. Les Grumdahl Window & Siding, LLC and Goutermont Exteriors LLC, the siding contractor, Grumdahl, tendered its defense and indemnity as an additional insured on its subcontractor, Goutermont’s, insurance policy. Deborah Eckland and Elizabeth Taylor determined that the allegations of the Complaint likely triggered coverage such that there was a duty to defend, but the policy only provided limited indemnity because it was only in effect for a fraction of the time the damage to this property was allegedly occurring. Goetz & Eckland was able to negotiate a compromise with Grumdahl and its insurer and the lawsuit was ultimately resolved.
