Alan King and Beth LaCanne successfully obtained summary judgment for their client in a construction defect case. Alan and Beth represented a concrete subcontractor involved in an extensive home remodeling project. While summary judgment is rare in general, it is particularly rare in construction defect cases, due to the many factual issues involved. The court was persuaded because the Plaintiff, the general contractor, and other subcontractors failed to provide any expert opinions, or point to other evidence that created a fact question regarding whether Alan and Beth’s client’s work on the project was defective or faulty.
