Plaintiff Kevin Wohlert was involved in an automobile accident while traveling on business in Nevada. Three separate carriers insured Wohlert at the time of the accident, but only Wohlert’s personal insurer, Westfield National Insurance Company, agreed to defend him against a lawsuit brought by the other driver. Deborah Eckland and Scott Johnson were retained to compel Hartford and Travelers to assume Wohlert’s defense and reimburse Westfield for costs and expenses incurred while defending Wohlert in the underlying lawsuit.
In a complicated declaratory judgment action involving multiple insurance companies, numerous policies and the application of the laws of three separate states, Deborah and Scott convinced the federal district court that Minnesota law applied and that Hartford and Travelers were closer to the risk than Westfield. Hartford and Travelers were ordered to assume Wohlert’s defense and reimburse Westfield for costs and expenses.
